U.S. and International Terms of Service (excluding the UK)
These Terms of Service ("Agreement") govern your ("you") use of the narishaktifoundation.co.in website and its successor sites ("Site") and are a contract between you and Nari Shakti Foundation Trust (including our affiliates, service providers, and partners, collectively "GlobalGiving," "we," "us," or "our"). This includes all content and information posted on the Site and the functionalities that allow you to donate, request donations, create accounts, apply for grants, set up fundraising campaigns, solicit donations for projects, or use any other feature provided through the Site.

1. Acceptance of Terms and Supplemental Terms
Nari Shakti Foundation Trust operates the Site under this Agreement, which includes the Privacy Policy and any additional guidelines, rules, terms, or limitations applicable to specific components of the Site (each a "Supplemental Term"), each incorporated herein by reference. Additionally, project leaders, nonprofit organizations, and any individual, organization, or company that provides due diligence or grant applications are subject to the terms and conditions specified in the Supplemental Terms included with such applications.
By making a payment, you represent and agree that you are at least 18 years old, legally competent, and entering into a legally binding contract with Nari Shakti Foundation Trust governing your use of the Site, including all Supplemental Terms. If you are accepting this Agreement on behalf of an agency or organization, you warrant that you have the legal authority to do so, and that agency or organization will be bound by this Agreement.

You acknowledge and agree that Nari Shakti Foundation Trust retains control over donated funds. If (i) a project is completed or fully funded, or (ii) Nari Shakti Foundation Trust receives a check payable to it without reference to a specific project or campaign, the donated funds will be allocated to the general fund of Nari Shakti Foundation Trust.

You agree that a printed version of this Agreement and/or any electronic communications from Nari Shakti Foundation Trust shall be admissible in legal or administrative proceedings to the same extent and under the same conditions as other business documents originally generated and maintained in printed form.

2. Amendments
Nari Shakti Foundation Trust reserves the right to modify this Agreement at its discretion from time to time. Such changes will be announced on the Site, and the revised Agreement will indicate the date of the latest amendment. Your continued use of the Site after these changes are published constitutes your acceptance of and agreement to be bound by the modified Agreement.

3. Modification, Suspension, and/or Termination
Nari Shakti Foundation Trust reserves the right, at its sole discretion, with or without notice, to modify the Site, including altering, suspending, or discontinuing all or any portion of the Site’s content or functionality. You agree that Nari Shakti Foundation Trust will not be liable to you or any third party for any such actions.

4. User Credentials
When expressing interest, listing a project, creating a fundraising campaign or registry, or making a donation, you will be asked to provide certain personal information, such as your name and contact details, and you will have the opportunity to select one or more usernames collectively.

You represent and agree that:
– You will provide accurate and truthful information and promptly update it to reflect any changes;
– You have all rights necessary to provide this information to Nari Shakti Foundation Trust;
– Your user ID is for your personal use only and cannot be transferred to any third party;
– You are fully responsible for maintaining the security and confidentiality of your user ID and all activities under it, with or without your knowledge;
– You will log out fully at the end of each session and promptly notify Nari Shakti Foundation Trust of any unauthorized use of your user ID;
– If accepting this Agreement on behalf of an agency or other entity, you represent that you have the authority to submit registration information on its behalf;
– Nari Shakti Foundation Trust will not be liable for any loss or damage resulting from your failure to comply with this section; and
– Any information submitted under your user ID is subject to the "Personal Information" terms specified in Section 4.

5. Profile and Forum Content
Nari Shakti Foundation Trust may allow you and other users to post information on the Site, including personal "profile pages" (each, a "Profile") and collaborative contributions to designated Site areas such as bulletin boards, message boards, chat rooms, forums, or Site and/or service content (each, a "Forum"). Nari Shakti Foundation Trust does not control or endorse any user-generated content posted by Site users (including staff and employees of Nari Shakti Foundation Trust who maintain Profiles or participate in Forums) and is not responsible for it. Furthermore, Nari Shakti Foundation Trust cannot control the use or misuse by others of information you post in your Profile or Forums. Section 10 describes the provisions of this Agreement related to content monitoring by Nari Shakti Foundation Trust.

Accordingly, you agree that under no circumstances shall Nari Shakti Foundation Trust be liable for any loss or damage arising from your reliance on any Profile or Forum content posted by users or for any use or misuse of any user content posted by you or others in connection with your Profile, participation in Forums, or your use of the Site.

6. Code of Conduct
Your use of the Site depends explicitly on your responsible and lawful participation in the Site community. Accordingly, without limiting the foregoing:

You agree and acknowledge that:
– Your use of the Site is subject to this Agreement and all applicable laws, rules, and regulations, including, without limitation, U.S. export controls, restrictions, or other federal rules and regulations limiting exports;
– Any information you provide in connection with your use of the Site must be truthful, accurate, and complete at the time provided; and
– You will regularly maintain, update, and correct such information.

You agree not to post, transmit, distribute, publish, use, or otherwise make available through or in connection with the Site any:

– Content that is threatening, harassing, defamatory, hateful, or intimidating, as determined at the sole discretion of Nari Shakti Foundation Trust;
– Content protected by copyright, trademark, trade secret, publicity rights, moral rights, or other proprietary rights without the owner’s permission;
– Content that causes criminal or civil liability; promotes violence or other conduct that constitutes a criminal offense; or provides instructional information about violent, offensive, or illegal activities;
– Hardware, software, devices, viruses, worms, Trojan horses, Easter eggs, time bombs, spyware, or other computer code, files, or programs that (a) may damage, interfere with, disrupt, or hijack the Site’s operation; (b) may mislead or harm others; or (c) monitor access to or use of the Site by others;
– Unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," communications, or any solicitation designed to obtain passwords, account information, or personal information from any user;
– Any "lobbying" or "electioneering" materials as defined by the U.S. Internal Revenue Code of 1986, as amended.

You agree not to use the Site for:

– Engaging in any fraudulent or illegal activities;
– Defaming, abusing, harassing, stalking, threatening, or otherwise violating the legal, privacy, publicity, or other rights of others;
– Impersonating any person or entity, falsely stating or otherwise misrepresenting your affiliation with any person or entity, or claiming or implying that Nari Shakti Foundation Trust or any Site user endorses any statements you make;
– Interfering with or disrupting the operation of any server, hardware, or software used in connection with the Site;
– Transferring or copying any protected content, materials, or information provided through any restricted part of the Site to any unrestricted part of the Site or any public forum;
– Preventing or restricting others from using the Site.

You agree not to perform any of the following without our explicit written consent:

7. Granting License to Nari Shakti Foundation Trust
You will retain ownership rights of the content posted on your profile and other locations on the site (each, a “Submission”). Except as provided here, Nari Shakti Foundation Trust will not republish your Submissions outside the site without your written consent. However, by posting a Submission, you grant Nari Shakti Foundation Trust a license to use, display, reproduce, distribute, and modify such Submissions to operate the site and make it available to users as outlined below.

For each Submission, you represent and warrant that:
– You have all necessary rights to post such Submission, grant the license under this agreement, and allow Nari Shakti Foundation Trust to provide other users on the site the required licenses in accordance with your privacy preferences; and
– Your posting of any Submission and the rights you grant comply with all applicable laws, regulations, and do not infringe any third-party rights.

8. License
Subject to your compliance with the terms and conditions of this agreement (including Section 7 and the Indian Penal Code (IPC), without limitation), Nari Shakti Foundation Trust grants you a limited, non-exclusive, non-transferable license to access and use the site, and to download and print content and information made available on or through the site (provided that you retain all copyright and other proprietary notices on such content), solely for your personal, non-commercial use. You may not republish such content or information on any other Internet, intranet, or extranet site, nor include it in any other database or compilation. Any other use of the site or its content and information is strictly prohibited. All rights not expressly granted to you, including all intellectual property rights (including trademarks and service marks on the site), are reserved by Nari Shakti Foundation Trust and its licensors.

15. Replacement
15.1 These terms and conditions supersede all previous terms and conditions relating to your use of our website.

15.2 Any legal disputes shall be subject to the jurisdiction of the district courts of Saharanpur only.

Donations may be allocated to specific campaigns.
Tax exemption certificates may be issued and used.
If a tax exemption certificate has been issued but not used, donors must return the certificate or submit a declaration of loss before starting the process.
